New Utah Law Addresses Time Frame for Trustees to Provide
Statement of Reinstatement

Legislation in Utah has been signed into law by Governor Gary Herbert that creates two significant changes for trustees. The purpose of the law as stated in the original bill is to “clarify a trustee’s responsibility to provide a statement of reinstatement or payoff amounts. Per the new law;

  1. Payoffs and reinstatements must be sent by certified mail or FedEx.

  2. Only have five business days to respond to requests. If a payoff request is received ten business days prior to the sale, and the quote is not sent out in the required timeframe the sale would have to be cancelled or postponed.
